Acceptable Use Policy
ARTICLE I. PURPOSE AND SCOPE
This Acceptable Use Policy, hereinafter "the Policy" or "AUP", establishes the mandatory conduct standards for all users of the Kyzen platform. Its purpose is to ensure that the Service is used in a legal, ethical, and responsible manner, protecting users, their contacts, and the operational integrity of the platform.
This Policy forms an integral part of Kyzen's Terms of Service and is binding on all registered users and workspace administrators. Given the Service's integration with Meta Platforms Inc.'s WhatsApp Business API, whose policies are equally binding on users, this Policy must be read in conjunction with documents published by Meta.
ARTICLE II. PERMITTED USES
The Kyzen Service is designed exclusively for the following legitimate uses:
(i) Management of WhatsApp conversations with customers who have provided prior and verifiable consent (opt-in). (ii) Response automation within the limits authorized by the WhatsApp Business API. (iii) Tracking and management of leads, contacts, and commercial activities. (iv) Internal communication between agents within the same workspace. (v) Sending marketing messages and notifications through message templates (HSM) previously approved by Meta Platforms Inc.
ARTICLE III. PROHIBITED USES
3.1. Unauthorized messaging and spam The following are expressly prohibited: sending unsolicited messages to contacts who have not provided explicit, prior, and verifiable consent (opt-in); using the Service for phishing, smishing, vishing, or any other form of deceptive or fraudulent communication; simulating human conversations in a way that leads the recipient to believe they are interacting with a real person, without clearly disclosing that the communication is managed by an automated system; and exceeding the sending volume limits established by Meta Platforms Inc.
3.2. Abuse of Artificial Intelligence Models Strictly prohibited: employing prompt injection, jailbreaking, or any method designed to bypass security and moderation filters configured by Kyzen or foundational model providers; using the AI's text generation capabilities to mass-produce defamatory content, disinformation, hate speech, or illicit material for distribution via WhatsApp; and subjecting AI models to intentionally excessive or malicious processing loads.
3.3. Illegal, harmful content and technical abuse Prohibited: distributing content that infringes intellectual property rights; transmitting pornographic, violent, defamatory, or discriminatory material; facilitating unlawful activities under Colombian law; introducing malware, viruses, ransomware, or any malicious code; performing reverse engineering or decompilation of the platform; and using automated scripts, bots, or crawlers for data scraping without Kyzen's prior written authorization.
3.4. Violation of Meta Platforms Inc. policies Kyzen expressly incorporates by reference the most recent version of the WhatsApp Business Messaging Policy and Meta Platforms Inc.'s Commerce Policy. Any violation of those documents by the User shall be considered a direct violation of this Policy. In particular, the Service may not be used in industries expressly restricted by Meta, including —by way of example and not limitation— weapons and ammunition, tobacco, alcohol, unregulated gambling, and unauthorized financial services.
ARTICLE IV. USER RESPONSIBILITY OVER THEIR CONTACTS
The User is solely responsible, towards their contacts and before competent authorities, for:
(i) Obtaining valid, prior, express, and informed consent (opt-in) from each contact before sending them messages through Kyzen. (ii) Complying with Law 1581 of 2012 and other applicable data protection regulations with respect to contact data. (iii) Providing and maintaining a functional and accessible opt-out mechanism so that contacts can request cessation of communications. (iv) Ensuring that data use is consistent with the purpose for which it was collected.
Kyzen assumes no liability for third-party claims or administrative sanctions arising from the User's misuse of contact data.
ARTICLE V. MONITORING AND SANCTIONS
Kyzen reserves the right to monitor platform usage to verify compliance with this Policy. Although routine monitoring of conversation content is not an ordinary Kyzen practice, the company may act on duly substantiated abuse reports or on technical signals indicating a violation.
Upon a detected or reported violation, Kyzen may, at its sole discretion and depending on the severity of the violation: (i) issue a formal warning to the User; (ii) temporarily suspend access to the Service; (iii) permanently and definitively cancel the account without right to a refund; and (iv) report the infringing activity to the Attorney General's Office, the Superintendence of Industry and Commerce, or any other competent Colombian authority, when the situation warrants it.
ARTICLE VI. ABUSE REPORTING AND UPDATES
Abuse reports, security vulnerabilities, and any concerns related to this Policy should be directed to: matt@kyzen.club. Kyzen guarantees the investigation of all reports submitted in good faith.
This Policy may be updated at any time to reflect changes in Meta Platforms Inc.'s policies, Colombian legislation, or Service features. Changes will be notified to the User with reasonable advance notice via email or platform notice.
